How do we determine the order of a state or it's units if they aren't given to us or stated?

To determine the order with respect to a reactant, you would need to use experimental data and determine how the rate changes in response to changes in the reactant. For example, if you have two experiments and a reactant, A, and in one experiment you triple the concentration of A, but observe a rate that increases by a factor of 9, you know that the rate is second order with respect to A. This is because a change by a factor of 3 in A causes a change by a factor of 9 in the rate. 9 is 3^2, so the order will be 2.
