If it doesn't cancel out then it is okay.

You put a catalyst in the overall rate law only if the catalyst is part of the reactants side of the rate-limiting step.

If the catalyst is still present in the rate limiting step, then you should include it in the rate law

Yeah, we include catalysts but not intermediates.
