E(max) is simply the maximum amount of voltage difference in a system. To change the E(max), the system itself would have to change in some way.

I think so, because there were a couple step up problems and sapling problems that involved finding the E naught value of the cell, which requires taking the difference in voltage of the Anode and Cathode.

Emax is the difference in voltage across the electrodes. E is a maximum because when there is a difference in voltage (switch open and no current is flowing), the potential energy is very high.

E max is the maximum voltage so it is basically the E naught value right when the system starts reacting. Remember how Dr Lavelle talked about how systems degenerate over time? Well we know that the maximum voltage potential (Emax) would be at the very very beginning before the system had time to degenerate and lose potential.
